Can a Couple Do Nikkah Two Times in Islam?
Yes, a couple can do Nikkah two times in Islam. There is no restriction in the religion of Islam on repeating the Nikkah ceremony between a bride and a groom.
Nikkah is basically a religious ceremony. Once it is performed, you become husband and wife. Being husband and wife, you can repeat the Nikkah ceremony two times or even more than two times.
Marriage Registration with the Same Wife
The registration of marriage in Pakistan is a legal requirement. Once you are married and have officially obtained a marriage certificate, you are legally married.
However, you can repeat the Nikkah ceremony, but once the marriage registration has been completed, you cannot obtain a new marriage registration with the same wife.
First in Time Will Prevail
If you have completed two or more marriage registrations with the same spouse in the government record, then, as per the general maxim of law, the first in time will prevail.
The law gives priority to any contract that was made first in time. Therefore, in the case of two marriage contracts between the same spouses, if there is any contradiction between the two, the first in time will prevail.
When Remarriage May Be Required
After marriage, there are certain situations in which the remarriage of the same couple may be required.
When the husband gives divorce to the wife, the period of 90 days begins. After the expiry of the iddat period, the husband and wife are no longer spouses.
However, both the religion of Islam and the law of Pakistan do not restrict a male and a female from remarrying each other after divorce. Therefore, if you are divorced and want to reunite, you have to remarry your previous spouse.
No Halala Required
After the divorce, once the divorce process in Pakistan is completed, you can officially remarry your previous husband or wife. For this, no halala is required under the religion of Islam or under Pakistani law.
According to Section 7, Subsection (6) of the Muslim Family Laws Ordinance, after divorce, a female can remarry her previous husband without any intervening marriage.
Your Personal Satisfaction
If you are not satisfied with your Nikkah ceremony and, for your personal satisfaction, you want to perform the Nikkah ceremony again, it is your own choice.
You have the right to conduct the Nikkah ceremony again. It is neither a legal requirement nor a religious requirement. It is only for your personal satisfaction.
No Requirement of Law
The law does not require you to conduct the Nikkah ceremony again and again. However, if a couple wants to perform the Nikkah ceremony for a second time, it is entirely their own choice.
There is no legal requirement for a second or third Nikkah ceremony with the same spouse.
Haq Mehr in Two Nikkahs
If there were two Nikkah ceremonies between the same spouses and there is a contradiction regarding the Haq Mehr in both Nikkahs, then the first in time will prevail.
Under Pakistani law, the general maxim that the first in time will prevail is followed.
Court Marriage for the Second Time
If spouses have already conducted a court marriage but are not satisfied, they may also conduct a court marriage for the second time in Pakistan.
Online Marriage for the Second Time
If, for any reason, the spouses are not satisfied with the procedure of the online marriage conducted for them in Pakistan, they may once again go through the online marriage process in Pakistan.
No Second Registration
Once the marriage is officially registered by a lawyer or a licensed marriage registrar, you are officially married.
After the marriage registration has been completed, there is no second marriage registration in Pakistan. You cannot register the same marriage again.
Common Mistake in Two Nikkahs
It is a common misconception that, after getting married, spouses cannot remarry each other or perform the Nikkah ceremony again.
However, neither the law nor the religion of Islam restricts a second Nikkah ceremony between the same spouses.
