HALALA NOT ALLOWED
The Muslim Family Law Ordinance Section 7 (6) says that any intermediate marriage, commonly known as “halala,” is not required for a couple to get remarried.

- Doing halala or offering halala is both a crime in Pakistan.
- If anyone does halala, they will be charged with the offense of Zina and will soon land in jail.

WHEN REMARRIAGE IS NOT ALLOWED AFTER DIVORCE
The remarriage is not required during the period of iddat.
- If the male divorces the wife, the divorce does not get finalized till the divorce certificate in Pakistan is issued.
- When the male divorces the wife, the iddat period starts.
- This iddat period is 90 days.
- This is a grace period given by Islam.
- During this grace period, the couples can rejoin even without getting remarried.
- All the husband needs to do is take back his words of talaq.
- He just has to inform his wife that he takes back his words, and then they can rejoin.
- There is no need for marriage also during this iddat period because during this period they were already husband and wife.
WHEN REMARRIAGE IS ALLOWED AFTER DIVORCE
If, after the divorce, the iddat period has expired and the divorce certificate is issued, then it means that they are now religiously and legally divorced.
- When a person is officially divorced, then the talaq does not get cancelled just by taking the words back because the iddat period has now expired.
- After the iddat period, the divorce certificate in Pakistan is issued.
- When the iddat period expires, the grace period is over.
- Now, if they want to rejoin, they have to do a new nikah with the new haq mehar.
IN CASE HUSBAND IS ABROAD AFTER DIVORCE
In case the iddat period has expired and the husband is abroad, then they can do an online nikah in Pakistan if they want to rejoin.
REMARRIAGE IN CASE OF KHULA
- In case of khula from the female side, the iddat period starts after the khula decree.
- When the court orders the khula, the divorce does not instantly happen.
- After the khula in Pakistan, the iddat period starts.
- You get this grace period even after the khula from the court.
- During this period, all the wife has to do is rejoin the husband and fulfill her matrimonial obligations, and the khula decree will come to an end.
