The relevant law for the issuance of a divorce certificate in Pakistan is Section 7 of the Muslim Family Laws Ordinance, 1961.

CASE LAWS REGARDING DIVORCE

Below are some of the relevant case laws regarding divorce in Pakistan:

  • PLD 1967 SC 580: Talaq given by a husband to his Christian wife, where the marriage was solemnized in London under the English Marriage Act, 1949, before a Registrar, is recognized as valid.
  • 1991 MLD 403: A decree for the dissolution of marriage does not become ineffective merely because a copy of the decree of Khula was not sent to the Arbitration Council in time.
  • 2006 YLR 1753: A divorce becomes valid only when the requirements of Section 7 of the Muslim Family Laws Ordinance, 1961 are fulfilled.

DIVORCE CERTIFICATE BY TALAQ FROM HUSBAND

In case of a divorce certificate by talaq from the husband, below is the procedure:

  • Draft a divorce deed.
  • Send a copy to the wife.
  • Submit the original to the Union Council.
  • The Council will issue notices to both the husband and wife.
  • The Council will send notices to both the husband and wife to bring at least two male family members from both sides.
  • The Council will try to have reconciliation between both of them for at least 90 days.
  • In case of failure of reconciliation, the Council will issue the divorce certificate.

DIVORCE CERTIFICATE THROUGH KHULA BY WIFE

In case of a divorce certificate through khula by the wife, below is the procedure:

  • The wife will obtain the attested copy of the khula decree.
  • The wife will submit the attested khula decree to the Union Council.
  • The Council will send notices to both the husband and wife and ask them to bring at least two male family members with them.
  • The Council will try to have reconciliation between both of them for at least 90 days.
  • In case the conciliation fails, the divorce certificate will be issued.

DIVORCE CERTIFICATE BY JUDICIAL DISSOLUTION

In case of a divorce certificate by judicial dissolution, the party will obtain the attested court orders and submit them to the Union Council. After the failure of reconciliation between the spouses, the divorce certificate will be issued.

DIVORCE CERTIFICATE BY MUTUAL DIVORCE

In case of a divorce certificate by mutual divorce, below will be the procedure:

  • Both husband and wife will draft the mutual divorce deed.
  • The original mutual divorce deed will be submitted to the Union Council.
  • The Council will issue notices to both the husband and wife and ask them to bring at least two male family members.
  • The Council will try to have reconciliation between them for at least 90 days.
  • In case of failure of reconciliation, the divorce certificate will be issued.

DIVORCE CERTIFICATE THROUGH DELEGATED TALAQ

In case of a divorce certificate through delegated talaq, below will be the procedure:

  • The wife will draft the divorce deed and will divorce herself.
  • The wife will submit the deed to the Union Council and send a copy of this deed to the husband.
  • The Council will send notices to both parties.
  • The Council will ask the husband and the wife to bring at least two male family members with them to facilitate reconciliation.
  • The Council will try to have conciliation for at least 90 days.
  • On expiry of 90 days, in case the conciliation fails, the Council will issue the divorce certificate.

WHAT IF YOU HAVE KHULA DECREE BUT NOT DIVORCE CERTIFICATE

If you have a khula decree but you do not have a divorce certificate, then legally you are not yet divorced. The divorce is not finalized after the khula in Pakistan. It gets finalized only after the talaq certificate in Pakistan.
