Is Court Marriage Halal in Islam & Pakistan:
In Islam, every marriage is halal when it meets the requirements set by the religion of Islam. In Islam, these requirements are mandatory for every marriage. These requirements are called the “faraiz.” The fara’iz of marriage in Islam are as follows.
Ø Marriage should be between a male and a female.
Ø It should be with the free consent of the parties.
Ø There should be an offer and acceptance called “ijaz o qabool.”
Ø It should be in the presence of witnesses.
Ø The dower amount should be fixed at the time of marriage.
Some Mandatory Conditions:
Above are the mandatory conditions set by the religion of Islam for marriage. If the court marriage fulfills the above conditions, then the marriage is halal, but if it does not fulfill the above conditions, then the marriage is haram. The court marriage fulfills all the above conditions in Pakistan. The above mentioned are also the mandatory court marriage requirements in Pakistan. In Other Countries:
The laws are different in different countries. If a country issues a marriage certificate to a couple in which all the above conditions are fulfilled, then that court marriage will also be halal, but if any of the mandatory conditions are missing during the services of the court marriage in their country, then the marriage will be haram according to the religion Islam, though it might be legally valid as per the law of that country.
Marriage Law in Pakistan:
There can be no law in Pakistan that is against the Quran and Sunnah, so the marriage laws of the country are also in accordance with the Quran and Sunnah. The Pakistani law also allows the services of a court marriage in Pakistan, even without the wali. In a case law of 2002, the Supreme Court decided in a case that a marriage is between a male and a female and not between their parents. Moreover, the court observed that the requirement of the offer and acceptance in marriage is required by both the male and the female, which are among the faraiz. There are no faraiz where the ijab a qabool is required from the parents of the bride and groom.
