Oral Nikkah in Pakistan?

Is Oral Nikkah Allowed in Pakistan?

Yes, an oral Nikkah is allowed in Pakistan, but it also has legal consequences, as the non-registration of a marriage is a crime. Conducting an oral Nikkah makes you husband and wife religiously, but to be officially and legally recognized as husband and wife, you must register your marriage in accordance with Pakistani law.

Religious Requirements of Marriage

Whenever a Muslim male and a female get married, it is a religious requirement to first conduct the Nikkah ceremony. Without the Nikkah ceremony, there is no marriage religiously. Therefore, an oral Nikkah is a religious requirement of every Muslim marriage.

Legally, a marriage is required to be registered. The law does not recognize an oral Nikkah as proof of marriage. Therefore, the registration of marriage in Pakistan is a legal requirement. Whenever you conduct a Nikkah, you must officially complete the Nikah Nama registration in Pakistan.

Punishment for Non-Registration of Marriage

The non-registration of a marriage is a crime under Pakistani law. According to Section 5(3) of the Muslim Family Laws Ordinance, 1961, anyone who does not register a marriage may be fined up to Rs. 1,000and may face imprisonment for up to three months.

Nikkah in Court Marriage

Even if the bride and groom avail themselves of court marriage services in Pakistan, the Nikkah is an essential part of the court marriage process. When you hire the services of a lawyer for the registration of a court marriage, the lawyer first arranges for a licensed Nikah Khawan appointed for the purpose to conduct the Nikkah ceremony.

Nikkah in Online Marriage

If you are conducting an online marriage in Pakistan, the oral Nikkah is still a part of the process. However, an oral Nikkah alone is not an online marriage; it is only one part of it. Officially and legally, an online marriage in Pakistan is completed only after the marriage is registered and you are issued a manual Nikah Nama and a computerized marriage certificate.

The law does not recognize an oral Nikkah as legal proof of marriage. For legal proof, you need documentary evidence. The Nikah Nama and the computerized marriage certificate are the only two documents recognized as legal proof of marriage.

No One Can Prove an Oral Nikkah

In the event of a dispute between the husband and wife, an oral Nikkah cannot easily be proved. This is why the registration of marriage has been made compulsory under Pakistani law. To prove your marriage, you need an official document issued by the government.

In Case of Childbirth

If your marriage is not registered and the wife gives birth to a child, there may be legal complications in the future regarding the child’s birth certificate, B-Form, or identity card. It is always recommended to register your marriage officially to avoid future legal complications.

In Case of a Criminal Complaint by the Wife

After an oral Nikkah, you are religiously a married couple, but you do not have legal proof of your marriage if it has not been registered. For example, if your wife alleges that you have committed zina, you may have no documentary evidence to prove that you are legally her husband.

Types of Nikkah Registration in Pakistan

There are two types of Nikkah registration in Pakistan:

  1. Manual Nikah Nama
  2. Computerized Marriage Certificate

The manual Nikah Nama is the manual registration of the marriage, whereas the computerized marriage certificate is the digital registration of the marriage.

Common Mistake Regarding Oral Nikkah

It is a common misconception among many couples that after conducting the Nikkah ceremony, they become officially married. This is not the case. You are legally recognized as a married couple only after you are issued the official marriage registration certificate in Pakistan.

It is legally advisable to always consult an expert family lawyer regarding the registration of a marriage. If you are facing any legal complications, it is better to hire the services of an experienced lawyer.
