Witness Required for Marriage in Pakistan?
Witnesses are a mandatory requirement of Nikah in Islam. As per the religion, the nikah without witnesses is void. The Pakistani law is also the same. According to the Muslim Family Law Ordinance 1961, the nikah, or even the online nikah in Pakistan, should be in the presence of witnesses. According to the law, at least two witnesses are required to get married in Pakistan. These witnesses should be present at the time of marriage. In the nikah nama, there are four columns of witnesses. There can be four witnesses of the marriage; these four are optional. In case there are four witnesses, two will be from the male side, and the other two will be from the female side. Though four witnesses are optional, at least two of them are mandatory. Witness in Online Nikah:
In the case of an online Nikah in Pakistan, there should be at least two witnesses. These witnesses can be physically present at the time of nikah, either on the husband’s side or from the wife’s side. Where the male and the female are both abroad, but the nikah khawan is in Pakistan, then in this case, the two witnesses can also be present with the nikah khawan. Witness in Court Marriage:
In the services of court marriage in Pakistan, at least two witnesses will be required. The court marriage is not done remotely. It can only be done through a lawyer when both the male and the female are physically present in the court or in the lawyer’s office. If you are doing a court marriage, then you have to bring your witnesses along with you. In case you don’t have the witnesses, you may request your lawyer to arrange the witnesses also. If the Spouse is abroad:
If the spouse is abroad and the other half is in Pakistan, then the person who is abroad has to appoint an attorney or wakil to represent him in his absence. For example, if the male is in the UAE and the female is in Pakistan, and the nikah is online, then he can appoint any person as his lawyer to represent him for his nikah. As per the law, a lawyer can be appointed as an attorney for the legal services of marriage and divorce in Pakistan.
Eligibility of Witness:
The witnesses for the marriage also have eligibility criteria. The witnesses should be male, adult, and Muslim. If the male witness is not available, then there can be a female witness, but the testimony of a female witness is considered. It means there should be either two male witnesses or four female witnesses. In a Muslim marriage, the witness should also be a Muslim. The testimony of a non-Muslim is not accepted in the case of nikah in Pakistan.
