Online Marriage Islamic Rules:
Like any other marriage, online marriage also has some rules to be followed. These rules have two parts. One is the religious rules set for marriage, and the other is the legal rules that every country sets for the registration of marriage. Online marriage is Islamic and set according to the guidelines of the Islamic religion. Rest, the legal rules are set by the laws of Pakistan. The Muslim Family Law Ordinance 1961 applies to the registration of online marriages in Pakistan.
Rules are Given Below:
Some of the online Islamic marriage rules are mandatory to follow, and some of them are optional and do not invalidate the marriage.
Free Will:
For an online marriage in Islam, the foremost rule is that the online nikah between the bride and the groom should be with free will and consent. Any marriage in which the consent of the bride or the groom is taken by force or by coercion is invalid. Any such marriage, either online or not, if the consent was not given by free will, will be void.
Offer and Acceptance:
In an online Islamic nikah, there is an offer and acceptance of the marriage, which comes from the bride and the groom. Both parties to the marriage should give their consent to the marriage. This offer and acceptance should be made of their free will and choice. In online marriage, the offer and acceptance of the bride and the groom can be on an audio or video call.
Witness:
The online marriage Islamic rules demand that the nikah ceremony should be conducted in the presence of at least two witnesses. These witnesses should be male and Muslim. In the absence of a male witness, at least two female witnesses for each male will be required. These witnesses can be present at the side of the bride or groom or on the side of the lawyer who is representing you in the nikah.
Dower:
The dower amount is mandatory in the online nikah in Islam. In an online nikah in Pakistan or Islam, the bride has the right to fix any amount as her dower, which the groom is bound to pay to the wife in case of dower. Without this dower amount, there is no nikah. This is a mandatory element in the online marriage Islamic rules.
Optional Rules:
Some of the rules are optional, which are termed “good to follow” in case of online marriage, but are not mandatory.
Nikah Khawan:
The presence of a nikah khawan in Pakistan is not mandatory, but it is optional. In online marriage, if you have hired a licensed family lawyer to represent you, then the presence of the nikah khawan is optional.
Khutbah:
The khutbah nikah is mustahab, which means it is good to have a khutbah at the end of the marriage ceremony, but it is not mandatory.
